1. Introduction
Welcome to HerbWild. These Terms of Service ("Terms") govern your use of the HerbWild website www.herbwild.com and the purchase of products from our store. By accessing our website or placing an order, you agree to be bound by these Terms.
HerbWild is operated by HerbWild Inc., an Ontario corporation.

2. Eligibility
To place an order with HerbWild, you must be at least 18 years old, or the age of majority in your province, state, or country of residence, whichever is older. If you are under the applicable age of majority, you may only use this website or place an order with the involvement and consent of a parent or legal guardian.
3. Products and Availability
HerbWild offers beginner-friendly herb garden collections that include live starter plants, a detailed garden guide, and access to expert support.
Because we sell live plants grown in our greenhouse, product availability is limited by season, growing conditions, and inventory. We reserve the right to:
- Limit quantities of any product
- Discontinue any product at any time
- Substitute a plant variety of equal or greater value if a specific variety becomes unavailable, with notice to you when possible
4. Orders, Pricing, and Payment
All prices are listed in CAD and do not include applicable taxes or shipping fees unless otherwise stated.
We accept major credit cards, PayPal, Shop Pay, and other payment methods made available at checkout.
Payment is charged at the time you place your order.
We reserve the right to refuse, limit, or cancel any order at our discretion, including orders that appear fraudulent, contain errors in pricing or product information, or cannot be fulfilled. If we cancel an order after payment has been processed, we will issue a refund to the original payment method.
In the event of a pricing, product description, or other website error, we reserve the right to correct the error and to cancel or refuse any affected order, even if the order has been submitted or confirmed. If your order is canceled in these circumstances, you will receive a full refund of any amount charged.
5. Shipping
HerbWild currently ships within Canada only.
During our active shipping season, generally from May 1 to August 31, plants and plant collections typically ship within 7 days of order placement, weather permitting. To help protect plant health, we ship only on Monday, Tuesday, and Wednesday so that orders do not sit in transit over the weekend.
Orders placed outside of our active shipping season are treated as pre-orders and will ship when the shipping season resumes.
Orders may also be delayed by 1 to 2 weeks due to weather or other shipping conditions that, in our discretion, may affect the viability of plants in transit or upon arrival.
HerbWild selects from a network of shipping carriers at the time of shipment in order to use the fastest available delivery option.
Risk of loss and title for products pass to you upon delivery to the shipping address provided at checkout, subject to our 15-day Healthy Plant Guarantee. If your plants arrive damaged or there is an issue covered by our 15-day Healthy Plant Guarantee, please contact us promptly and we will review the issue in accordance with that policy.
6. Returns and Refunds
All HerbWild plant collections are covered by our 15-day Healthy Plant Guarantee. Full details about eligibility, claims, refunds, and how to submit a request are set out in our Refund Policy.
For non-plant products, including accessories and other merchandise, HerbWild accepts returns within 30 days of delivery, provided the item is unused, in new condition, and in its original sealed packaging, unless the item was received defective, damaged, or incorrect.
To initiate a return for a non-plant product, you must contact us at support@herbwild.com within the applicable return period. Unless the item was received defective, damaged, or incorrect, return shipping costs are the responsibility of the customer.

HerbWild does not accept returns on final sale items, gift cards, perishable goods, or any item marked non-returnable at the time of purchase.
Returned non-plant items must be received in their original condition in order to qualify for a refund. Returns or refunds will not be provided for items that have been damaged through misuse, neglect, or improper handling after delivery. We reserve the right to refuse returns that do not meet the conditions set out in these Terms or our Refund Policy.
Refunds for eligible returns will be issued to the original payment method after the returned item has been received and inspected. Original shipping charges are non-refundable unless the return is due to a defective, damaged, or incorrect item. Please allow a reasonable processing period after receipt and inspection of the returned item for the refund to appear on your original payment method.
HerbWild does not offer direct exchanges. If you would like a different non-plant item, please return the original item in accordance with this policy and place a new order.
7. Plant Care and Guarantee Limitations
HerbWild provides each collection with a detailed garden guide and access to our team for expert support. While we do everything we can to set you up for success, the long-term health of your plants depends on factors outside our control, including your local climate, growing conditions, and care routines.
Our Healthy Plant Guarantee covers the first 15 days after delivery. Beyond that window, the continued care and health of your plants is the customer's responsibility.
8. Wellness and Herbal Use Disclaimer
HerbWild may provide information, recipes, guides, suggestions, and other content relating to herbs and their traditional, culinary, household, or general wellness uses, including uses such as teas, seasonings, and home remedies. All such content is provided for general educational and informational purposes only.
HerbWild does not provide medical advice, diagnosis, treatment, or other healthcare services. Nothing on our website, in our guides, in product descriptions, in emails, on social media, through customer support communications, or in any other content we provide is intended to diagnose, treat, cure, or prevent any disease, illness, or health condition, or to replace the advice of a physician, pharmacist, or other qualified healthcare professional.
References to traditional, historical, or customary uses of herbs are included solely as cultural or educational information and do not constitute claims about safety, efficacy, or medical benefit.
You should always consult a qualified healthcare professional before ingesting, preparing, applying, or otherwise using any herb for health or wellness purposes, especially if you are pregnant, nursing, trying to conceive, taking any medication or supplement, have any allergy or sensitivity, have any medical condition, or are considering use by a child.
You are solely responsible for determining whether any herb, preparation, or use is appropriate for you. This includes responsibility for proper plant identification, safe handling, preparation, dosage, storage, and use, as well as responsibility for checking for allergies, sensitivities, contraindications, side effects, and potential interactions with medications, supplements, or medical conditions.
Herbs and herbal preparations should be kept out of reach of children and pets unless a qualified professional has advised otherwise.
HerbWild makes no representations, warranties, or guarantees regarding the health, medicinal, therapeutic, or wellness effects of any herb or any information provided on our website or in connection with our products. Individual reactions and outcomes may vary.
To the fullest extent permitted by applicable law, HerbWild disclaims all liability arising from or relating to the ingestion, preparation, application, misuse, or use of any herb or herb-related information provided by HerbWild, including any allergic reaction, adverse event, interaction, injury, illness, or other loss or damage.
9. Intellectual Property
All content on the HerbWild website — including text, images, logos, product photography, garden guides, videos, and design elements — is the property of HerbWild Inc. and is protected by copyright and trademark laws.
You may not copy, reproduce, distribute, or create derivative works from any of our content without our prior written permission. You may share links to our website and product pages for personal, non-commercial purposes.
10. User Accounts and Submissions
If you create an account on our website, you are responsible for maintaining the confidentiality of your account credentials, including your password, and for restricting access to your account and device. You agree to accept responsibility for all activities that occur under your account.
You agree to provide current, complete, and accurate account information and to promptly update that information if it changes. HerbWild is not responsible for any loss or damage arising from your failure to maintain accurate account information or to keep your account credentials secure.
We reserve the right to suspend, restrict, or terminate any account, refuse service, or cancel orders at our discretion, including where we believe an account is being used fraudulently, unlawfully, abusively, or in violation of these Terms.
If you submit or post any content to HerbWild, including product reviews, testimonials, comments, quiz responses, survey responses, messages, contact form submissions, photos, or other materials, you represent and warrant that: (a) the content is accurate and your own or that you otherwise have the right to submit it; (b) the content does not violate any law or the rights of any person or entity; and (c) the content is not false, misleading, defamatory, obscene, abusive, infringing, or otherwise objectionable.
By submitting content to HerbWild, you grant HerbWild a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise use that content in connection with our business, marketing, website, products, and services, in any media now known or later developed, without further notice, compensation, or obligation to you, except where prohibited by law.
You acknowledge that any information you submit through quizzes, forms, surveys, or similar features may be collected, stored, and associated with your customer profile and used in accordance with our Privacy Policy.
We reserve the right, but not the obligation, to monitor, edit, refuse, or remove any submitted content at our discretion and without notice.
11. Acceptable Use
You agree not to use our website to:
- Engage in fraudulent activity or misrepresent your identity
- Violate any applicable law or regulation
- Infringe on the rights of HerbWild or any third party
- Interfere with or disrupt the website, servers, or networks
- Upload harmful code, malware, or attempt unauthorized access
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if these Terms are violated.
12. Disclaimers
Our website and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, HerbWild makes no warranties — express or implied — beyond those explicitly stated in these Terms and in our Healthy Plant Guarantee.
We do not guarantee that:
- The website will be uninterrupted, secure, or error-free
- Product descriptions, colors, or images are completely accurate (though we work hard to represent our products honestly)
- Every customer will achieve specific growing results, as outcomes depend on individual conditions and care
13. Limitation of Liability
To the fullest extent permitted by law, HerbWild's total liability to you for any claim arising out of or relating to these Terms, your use of the website, or your purchase of any product, shall not exceed the amount you paid for the product giving rise to the claim.
HerbWild will not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or enjoyment.
14. Indemnification
You agree to indemnify and hold harmless HerbWild, the Richters family, our team, and our affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the website, violation of these Terms, or infringement of any third-party rights.
15. Governing Law and Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, your use of the HerbWild website, or your purchase of products from HerbWild shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Before starting a legal proceeding, you agree to first contact HerbWild at support@herbwild.com and provide a brief written description of the issue so that the parties have an opportunity to try to resolve the matter informally and in good faith.
Subject to any rights you may have under applicable consumer protection laws, you agree that the courts of the Province of Ontario, Canada shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website, or your purchase of products from HerbWild, and you attorn to the jurisdiction of those courts.
Nothing in these Terms limits any rights or remedies that cannot be excluded, waived, or limited under applicable law.
16. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on this page with the "Last updated" date at the top. Your continued use of the website or placement of new orders after changes are posted constitutes acceptance of the updated Terms.
